Truck Tire Limited Warranty & Casing Policy

GENERAL
This warranty is in effect for the original purchaser only. The limited retread casing warranty made by Sumitomo Tire (Treadways Corporation) applies to Sumitomo brand truck radials sold by Treadways Corporation in the United Sates only. All tires covered by this warranty must have a D.O.T. It supersedes the Sumitomo Consumer Limited Retreading Casing Warranty for Radial Truck Tires previously in effect and shall be effective with respect to radial truck tires purchased on or after January 1, 1998. That previous warranty shall not be applicable to any tires purchased after that date. The Claim Procedures, Exclusions and Limitations sections of this warranty should be read carefully. They provide limitations on the applicability of this warranty and set forth the procedures you must comply with in order to obtain the credits on new purchases offered by this limited warranty. If a tire becomes unserviceable due to a workmanship related condition within 2/32" of the original usable tread has been worn, the tire will be replaced with a comparable new Sumitomo tire free of charge. Original, usable tread is defined as the original tread down to the level of the treadwear indicators (2/32" tread remaining), at which time the tire is considered to be worn out. When more than 2/32" of the original usable tread has been worn, the user must pay for the cost of a replacement tire based on the amount of tread used. This is calculated by dividing the number of 32nds by the original usable tread depth and multiplying by the current dealer selling price. The cost of mounting and balancing and applicable taxes must be paid by the user. RETREAD CASING WARRANTY In addition to the limited warranty extended to all Sumitomo tires, as stated above, if any Sumitomo radial truck tire casing becomes unserviceable or cannot be retreaded because of a workmanship related condition, a casing allowance will be granted. Every Sumitomo radial tire casing (except the ST758 and ST748A) will be warranted to the first purchaser during its first and second retread life for a period of four (4) years from the date of manufacture. The ST758 and ST748A are warranted to the first purchaser for five (5) years on unlimited numbers of retreads. For any casing which becomes unserviceable due to a workmanship condition during the first or second retread life and before expiration of that four (4) year period, or unlimited retreads before the expiration of five (5) years for the ST758 and ST748A , Sumitomo Tire will give a casing allowance, as set forth in the following table across from the tire size of the unserviceable tire, toward the purchase of a new Sumitomo radial truck tire. Under no circumstances will credit be given if the tire has worn down less than 2/32" of tread depth, in any groove on the tire. A cash refund will not be given in lieu of the credits provided for unless Sumitomo Tire in its sole discretion so elects. No Sumitomo distributor or representative has the authority to make any commitment, promise, addition or modification to the terms of this express warranty. All implied warranties, with respect to Sumitomo Tire, either of merchantability or otherwise, are to the maximum extent permitted by applicable law, disclaimed entirely or, if not so disclaimable, limited in duration to the period of this express limited warranty. Sumitomo shall not be responsible for (1) any commercial loss, (2) any damage to, or loss of property other than the tire itself, or (3) any other incidental damages permitted by law, arising from any defect in any Sumitomo Tire. Some states do not allow limitation on how long an implied warranty lasts, or the exclusions of incidental damages, so the above limitations may not apply to you. This warranty gives you specific legal rights and you may also have other right which vary from state to state. If it should be determined that the remedies set forth in this limited warranty fail of their essential purpose, the buyer's remedies against Sumitomo for any breach or warranty shall be limited to a return of the unserviceable tire to Sumitomo, reduced by the depreciation of such tire.
